Child Custody and Parenting Plans
If you have filed for divorce in Florida recently or are considering filing, and have minor children, you should know that significant changes have been made to Florida's laws governing parenting time (formerly known as child custody). The State of Florida no longer user the terms "residential parents" or "secondary parents." Under the new statute, the court must approve and enter a parenting plan that details issues such as time-sharing, transportation and exchange, and communication between parents and children. As with the prior law, the primary concern when formulating the parenting plan is the best interests of the children.
We will help you establish and implement a parenting plan that is in the best interests of your minor children while protecting your rights as parents. Any such plan will consider the educational and medical needs of your children.
Our Child Support Practice
In Florida, child support is calculated using state guidelines based on the incomes of both parents. Health insurance, day care and other special needs may also be part of the formula.
We will review any proposed child support order for compliance with the Florida guidelines. We will also help to present information to the court so that all relevant income, including self-employment income, commission-based income and seasonal income, is properly considered. If your circumstances change dramatically after an order has been entered, we can help you petition the court for child support modification.
