When You Want to Use Mediation or a Collaborative Approach

If you are considering filing for divorce or are already a party to a divorce proceeding, you may have many reasons for seeking an alternative to litigation as a way of resolving your differences. Our Mediation Practice

In family law mediation, a neutral third party works with you and your spouse to help you find solutions that are mutually acceptable or beneficial. The mediator does not take testimony from witnesses, does not rule on issues of law and does not render any verdict for you. Instead, the mediator works with both parties to find ways in which to resolve all of your differences without going to court. If you come to agreement on the issues, you sign a contract, which will be enforced by the court.

Attorney Culver is certified as a family law mediator by the state of Florida. We can act as the mediator in any family law matters you have.  We can also act as your attorney in a proceeding with another mediator, or we can simply help you prepare to represent your own interests in mediation.

Our Collaborative Law Practice

In the collaborative law process, both parties are represented by counsel, but agree to resolve all differences without the intervention of the court or the judge. In the collaborative process, family counselors and financial professionals are often called upon to help structure parenting plans, child support and property agreements. The collaborative law process can also be used in post-divorce situations. If the parties in a collaborative law process cannot come to agreement on all the issues and must seek the involvement of the court, they must also hire new counsel to handle any further issues.
